2. Legal Basis

The implementation of ISPS Code compliance assessments is based on the following legal documents:

• Vietnam Maritime Code No. 95/2015/QH13 dated November 25, 2015;
• ISPS Code Section B/16.62.4 requires the contents of the Port Facility Security Assessment (PFSA) report;
• Circular No. 27/2011/TT-BGTVT dated April 14, 2011 on the implementation of the 2002 amendments to the International Convention for the Safety of Life at Sea (SOLAS), 1974, together with the ISPS Code;
• Official Dispatch dated January 14, 2004 from the Vietnam Maritime Administration, designated by the Ministry of Transport as the Competent Authority, notifying Vietnamese seaports of the application of the ISPS Code;
• Circular No. 192/2016/TT-BTC stipulating the rates, collection, remittance, management, and use of fees for the appraisal and approval of port facility security assessments and plans, and for the issuance of ship security documentation;
• Official Letter No. 976/CHHVN-ATHH dated June 24, 2005 issued by the Vietnam Maritime Administration;
• Circular No. 03/2024/TT-BGTVT dated February 21, 2024 of the Ministry of Transport amending and supplementing several articles of Circular No. 27/2011/TT-BGTVT dated April 14, 2011 of the Minister of Transport, regarding the application of the 2002 amendments to the 1974 International Convention for the Safety of Life at Sea, accompanied by the International Ship and Port Facility Security Code.
