Pursuant to the provisions of the Law on Chemicals, Decree 113/2017/ND-CP detailing and guiding the implementation of a number of articles of the Law on Chemicals, chemical enterprises need to check whether they belong to obtain the Certificate of Eligibility for Production or Trade in Conditional Industrial Chemicals (hereinafter “CIC”) or not. In order to apply for this Certificate, the enterprise must meet specific conditions prescribed by law on a number of issues such as production business, fire protection standards, qualifications of the head of the establishment or the person in charge of chemical management, etc.
So:
- Which enterprises must apply for CIC and which agency will issue the certificate?
- How is the procedure implemented and How long does it take to get a certificate?

- Businesses need to apply for a license
In order to check whether an enterprise needs to apply for a CIC or not, the enterprise needs to review the company’s current list of chemicals or chemicals planned to produce or trade and compare with the following list:
- Chemicals on the list of conditional industrial chemicals stated in Appendix I attached with Decree 113/2017/ND-CP of Goverment.
- Mixtures of chemicals specified in Appendix I and Appendix II attached with Decree 113/2017/ND-CP not subject to restricted industrial chemicals mentioned in Article 14 of Decree 113/2017/ND-CP that are classified according to Article 23 of Decree 113/2017/ND-CP subject to at least one of the following groups:
- Category 1/Category 2/Category 3 or type A/B/C/D hazardous material;
- Category 2 and Category 3 acute toxicity (through variable exposures);
- Category 1/Category 2/Category 2A serious eye damage/eye irritation;
- Category 1 and Category 2 skin corrosion/irritation;
- Category 2 carcinogenicity, germ cell mutagenicity, or reproductive toxicity;
- Category 1 environmental hazard.
- Agency issues the CIC
Article 3, Clause 3 of Decree 82/2022/ND-CP specified that The Department of Industry and Trade (DoIT) of the province where the headquarter of the applicant is located shall inspect, issue, reissue or revise the certificate to the applicant.
- Implementation procedure and tentative schedule
The company shall retain the CIC at the factory/store as the basis for supervising safety at the chemical factory/store and present it to competent authorities if required.
