In recent times, the government has been promoting the growth of solar power through the following documents: Decision No. 13/2020/QD-TTg, dated April 6, 2020, on development incentive mechanism solar power in Vietnam; Decision No. 02/2019/QD-TTg, dated January 8, 2019, amending and supplementing several articles of Decision No. 11/2017/QD-TTg; and Decision No. 11/2017/QD-TTg, dated April 11, 2017. Solar systems have been installed and built-up on rooftops by numerous organizations and individuals in the provinces of Dong Nai, Binh Duong, Long An, Can Tho, Binh Dinh, etc.
Furthermore, this kind of electrical project has risky components that could endanger the environment and safety of the surrounding project where the Solar systems are placed. As a result, Investors must abide by the following legal requirements:
- Document No. 3288/C07-P4 dated September 8, 2020 of the Fire and Rescue Police Department on guiding the design appraisal and approval of fire protection for solar power plants and rooftop solar power systems;
- Document No. 1634/BXD-HDXD dated April 8, 2020 of the Ministry of Construction on licensing construction for solar power systems on factory roofs of enterprises in industrial parks;
- Document No. 4033/TCMT-QLCT dated December 14, 2020 of the General Department of Environment on legal procedures and solutions to ensure environmental protection requirements for rooftop solar power investment projects housing and support in determining hazardous waste thresholds for waste solar panels;
- Document No. 136/UBND-KT dated January 7, 2021 of the People’s Committee of Binh Dinh province on disseminating the document “Technical instructions related to construction safety when installing solar power systems” sky and roof”;
When investing in rooftop solar systems with a capacity of less than 1MWp, whether for self-use for production and living or to sell electricity to EVN, the investors must fully complement the environmental registration documents, which include the following (if they meet the relevant legal requirements):
- Construction permit
- Construction safety report when installing rooftop solar systems
- Fire fighting license
- Register the project’s environmental protection according to the provisions of Article 49 of the Law on Environmental Protection No. 72/2020/QH14
